Man Jailed 20 Years For Raping 12-year-old

An Ikeja Special Offences Court, on Friday, sentenced a 38-year-old barber, Jobi Kayode, to 20 years in prison for raping his 12-year-old neighbour (name withheld).

The News Agency of Nigeria (NAN) reports that Justice Oluwatoyin Taiwo sentenced Mr Kayode after finding him guilty of a charge of defilement due to the strength of the complainant’s testimony and the medical evidence.

“The prosecution has proved its case beyond reasonable doubt and I hereby convict him on the offence of defilement, as charged.

“The instances of rape have become prevalent in our society and it is almost becoming an epidemic. The defilement of a 12-year-old neighbour, who trusted him as her neighbour, is heinous.

“The defendant is hereby sentenced to 20 years in prison, to be served at the Kirikiri Correctional Centre, with no option of fine. The sentence starts from today, November 8, 2019,” the judge said.

NAN reports that five witnesses (the complainant, her parents, a medical doctor and a police officer) testified for the prosecution during the trial, while Mr Kayode testified solely in his defence.

The complainant (name withheld), who was a Junior Secondary School One (JSS1) student, while testifying during the trial, had said that the convict had the habit of making lewd advances at her and showing her his manhood whenever she was heading home from school.

While being led in evidence by Mr F. O. Ligali, the lead prosecuting counsel, she said “I usually close from school at 4 pm. from Mondays to Thursdays and 2 pm. on Fridays.

“Whenever I’m coming back from school, he (defendant) usually makes advances at me and sometimes brings out his penis and shakes it at me,” she said.

The student said that one day when she was opening the gate to the compound of her home, the defendant approached her and told her he wanted to see her neighbour in the compound.

She said that immediately he got into the compound, he overpowered her and raped her.

“He threatened me that if I should tell anyone about what he did to me, he would kill me,” she said.

The complainant said she did not tell anyone about the incident and that three days later, he approached her again while she was opening the gate of her compound, telling her, again, that he wanted to see her neighbour.

“He promised not to rape her and when he got into the compound, he rushed at me faster than the first time and raped me. He again threatened to kill me if I should tell anyone,” she said.

The complainant said that she did not tell her parents about the incident but that she revealed the incident after a Non-Governmental Organisation (NGO) who came to give sex education in her school.

She said she confided in a member of the NGO team about the defilement, who later informed her teacher who, in turn, told her to inform her parents but that she declined to tell her parents out of fear.

According to her, her mother was informed about the rape by her teacher during a PTA meeting, while the mother informed her father who, in turn, reported to the authorities.

Mr Kayode, in his defence, denied raping his neighbour.

“I had, at no time, visited the complainant’s compound. Their gate was always locked with a padlock,” he said.

Before the sentence was passed, Saheed Sanusi, the defence counsel, in his allocutus (plea for mercy), had asked the court to temper justice with mercy.

“We plead for leniency; the defendant is a first time offender; he has a family to look after. His family will suffer as a result.

“We plead the court for leniency so that he will continue to support his family. He has learnt his lesson; such an incident will not happen again,” Sanusi pleaded.

According to the prosecution, the convict committed the offence on June 21, 2015, at the Shangisha area of Lagos.

“The offence contravenes Section 137 of the Criminal Law of Lagos, 2011,” Ligali said.

Iliasu reportedly confessed to killing his brother, Isah Abubakar, in Gwanara, Baruten Local Government area of the state.

The First Information Report (FIR) said that one Abubakar Umaru of Budo-Aiki, Fulani camp, via Gwanara, reported the matter at the community police post, before it was transferred to the State Criminal Investigation and Intelligence Department, Ilorin, for discreet investigation.

According to the FIR, Umaru, who is the father of the two, had gone to the camp of his sons, Isah and Illiasu Abubakar, but found no one around except their cattle.

FIR revealed that Umaru found Isah’s body. Isah’s neck reportedly bore machete marks. His brother was nowhere to be found. Investigation revealed that Iliasu may have killed his brother and fled to Oyo State.

After he was arrested, the defendant confessed to the police to have cut his brother in the neck because he was having an affair with his wife.

The police report noted that the deceased had once claimed to be the three-year-old baby his brother’s wife is nursing. The defendant, after confessing to the crime, said he had warned the deceased severally to desist from the act but failed to listen, and as such, attacked him, FIR said.

The prosecutor, Inspector Sanni Abdullah, prayed the court to remand the defendant in prison custody saying the offences against him is not admissible for bail. He submitted further that the offences cannot be tried at the magistracy hence the need to remand Iliasu till the matter is transferred to the appropriate court for hearing.

The prosecutor added that the defendant may commit a similar offence if admitted to bail, saying he should rather be kept in the correctional centre pending the determination of the case.

The case continues on November 26.

15-Year-Old Boy Sodomizes 6-Year-Old Boy In Kaduna

“After our investigation, we found out that the boy’s anus had been penetrated. He is currently undergoing medical treatment and rehabilitation. The perpetrator was also brought to us by the Police and he confessed to have been sexually abused too by someone whom he couldn’t name; he is also currently receiving treatment,” she told NAN

Umar-Faruq added that the matter was under investigation by the Police.

He described the Nigerian government forces as the “puppets” of the trio, which has been pushing the military forces to carry out the deadly crackdown against Sheikh Zakzaki’s supporters.

He said that the Nigerian forces started the brutal assault against Sheikh Zakzaki supporters ever since they publicly condemned Israel for its atrocities against the Palestinian people during a demonstration marking International Quds Day.

The International Quds Day is a legacy of the late founder of the Islamic Republic, Imam Khomeini, who designated the day in solidarity with Palestinians. Since the 1979 Islamic Revolution in Iran, the International Quds Day has been held worldwide on the last Friday of the Muslim fasting month of Ramadan.

Zakzaky has been in detention since December 2015 after his residence in the city of Zaria was raided by Nigeria’s forces, during which he was beaten and lost vision in his left eye.

During the brutal crackdown, three of his sons lost their lives, his wife sustained serious wounds, and some 350 of his followers were killed.

Since then, the government has been violently cracking down on the IMN and its members.

The Islamic Human Rights Commission (IHRC), based in London, said last month that the cleric’s health condition had further deteriorated, since he was reportedly poisoned in prison.

The cleric’s son, Mohammad, told Press TV on July 6 that his father was in dire need of medical treatment, as “large and dangerous quantities of lead and cadmium have been found in his blood.” He said that the authorities intended to murder his father since they refuse to take any measures.

Recently, a Nigerian court granted the government permission to label the IMN as a “terrorist” group, a move that many believe would give the officials the opportunity to clamp down harder on it.

IMN members regularly take to the streets of the Nigerian capital to call for the release of Zakzaky.

Elsewhere in his Monday interview with Press TV, Shojaeifard said that the court was “unlawful” since Sheikh Zakzaki, his wife and the IMN had committed no crime.

He said that the court “is under the control of Saudis, Israelis and the United States.”
